Homeowners are required to register their backyard swimming pool and have compulsory safety checks of fences under tough new laws introduced in October.
A comprehensive review of the Swimming Pools Act 1992 has been finalised which identified a number of amendments designed to enhance the safety of backyard swimming pools in NSW.
The move will bring NSW into line with most of the other states with the previous Act requiring pool owners to simply construct a fence around their pool without any ongoing checks.
Blue Haven Pools Chief Executive Officer Remonda Martinez applauds the revised Act that requires all pool owners to register their backyard swimming pool to ensure regular safety checks.
“Safety should be paramount with a backyard swimming pool and this new legislation will help give pool owners peace of mind knowing their backyard pool is not only enjoyable for the family but safe,” Mrs Martinez says.
The online state-wide register of NSW’s 340,000 swimming pools will be held by the Division of Local Government and will record the address, type of pool, date of construction and the date of any safety inspection.
Safety inspections would be run by councils, and include all public swimming pools and those in hotels, resort and apartment blocks.
The Swimming Pools Amendment Act 2012 commenced on 29 October 2012 and makes a number of amendments to the Swimming Pools Act 1992: Information is provided below regarding the impact of these legislative amendments for pool owners.
Pool Owners:
1. Swimming pool owners are required to register their swimming pools on an online register to be provided by the NSW State Government.
2. Swimming Pool owners will be required to self-assess, and state in the register that, to the best of their knowledge, their swimming pool complies with the applicable standard when registering their pool.
3. There is a penalty for owners who fail to register a swimming pool (penalty notice amount of $220).
4. Swimming pool owners will be required to provide a valid swimming pool compliance certificate before being able to sell or lease a property with a pool.
5. Accredited certifiers under the Building Professional Act 2005 may conduct swimming pool inspections initiated by the pool owner.

The Act includes a staged implementation process to facilitate:
1. The development and implementation of the Swimming Pools Register (to commence by no later than 29 April 2013)
2. Registration by pool owners of pools (after the register commences and by no later than 29 October 2013)
3. Councils’ inspection programs (to be developed in consultation with the community, adopted and commenced by no later than 29 October 2013)
4. Mandatory inspections by councils of tourist, visitor and multi-occupancy developments, and pools associated with property sale and lease (to commence by no later than 29 April 2014).

1) Keep the water clean with a skimmer at least once a week to keep it free from bugs and leaves.
2) Use a pool cleaner or vacuum or brush the debris on the bottom of the pool towards the main filter. This will give your pool a sparkling effect.
3) Clean and replace your filter every 2 to 5 years. It is important to regularly check your filter.
4) It is important to regularly check the chlorine and pH levels.
5) Regularly empty the basket in the skimmer to keep it free of leaves, bugs and debris.
6) Wind can carry twigs, leaves and debris into the pool so choosing the right plants for your poolside landscaping can be the difference between relaxing poolside or spending hours skimming leaves from the pool’s surface.
7) Get a pool cover. This will stop any leaves and debris from falling into the pool and it will keep the temperature of the water warmer and is effective against evaporation.
8) The taller the pool fence the less likely debris is to fall into the pool. Having a high fence doesn’t mean you have to block out the view either; glass fencing is equally as effective at keeping any unwanted bits and pieces from flying into the pool.
9) Get things right the first time around! Some pool filters are easier to clean than others so do your research. Also regular maintenance ensures your pool filters will work more efficiently.

Just because a pool looks clean doesn’t necessarily mean it’s safe to swim in. From the minute the pool is filled with water, bacteria starts to grow on the pool walls, pipes, plumbing and in the filter.

Bacteria starts to breed, multiply, divide and grow within minutes. The bacteria colony begins to protect itself against invasion from lethal factors such as chlorine or bromine.
